MN Court of Appeals Strikes Down Sprinkler Mandate

EDINA, MINNESOTA(October 13, 2015) – The Minnesota REALTORS® issued the following statement from MNAR® Chief Executive Officer Chris Galler, following the announcement of the Minnesota Court of Appeals decision in Builders Association of the Twin Cities vs. Minnesota Department of Labor and Industry (DOLI), in which the Court struck down the Minnesota Department of Labor and Industry’s administrative rule requiring in-home sprinkler systems on all new residential construction over 4,500 square feet.  Galler said:

“Today, the Minnesota Court of Appeals sided with Minnesota homeowners and rejected the Minnesota Department of Labor and Industry’s disastrous rule that has impacted new home construction permits and would have added more than $10,000 to the cost of new construction.”

Galler continued, “By rejecting the arbitrary standards set forth by DOLI, the Court stands with the majority of lawmakers and countless Minnesotans who have stood up in the past few years and voiced opposition against this reckless regulation.”

NAR Call for Action: Stop Patent Trolls

Click here to respond to the Call for Action

Tell your U.S. Representative to support H.R. 9, the Innovation Act to stop patent trolls and protect the real estate industry from frivolous lawsuits.

REALTORS® across the country receive threatening demand letters and lawsuits alleging patent infringement based on the use of common business tools such as drop down menus or search alert functions on websites and the scanner function on a copier. These patent trolls buy vague patents and use them to turn everyday business practices into potential lawsuits.

H.R. 9 is scheduled for House floor consideration next week.   Congress must pass this common-sense comprehensive patent litigation reform to protect Main Street businesses and REALTORS® from patent troll abuse.

REALTORS® Laud President’s Action to Lower Cost Prohibitive FHA Insurance Premiums

Media Contact: Jenny Werwa / 202-383-1193 / Email

PHOENIX (January 8, 2015) –

The following is a statement by National Association of Realtors® President Chris Polychron:

“The National Association of Realtors® applauds new policy initiatives announced today by President Barack Obama that will enable more first-time and underserved homebuyers to enter the housing market while preserving strong underwriting standards and protecting taxpayers from unnecessary risk.

“As the leading advocate for homeowners, Realtors® strongly support Obama’s plan to reduce annual mortgage insurance premiums on home loans backed by the Federal Housing Administration, which are currently so expensive that in 2014, roughly 234,000 creditworthy borrowers were priced out of the market.

Tell the EPA to Withdraw their Proposed Rule to Regulate Most Water Bodies

Tell the EPA to Withdraw their Proposed Rule to Regulate Most Water Bodies

September 18, 2014

The Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (The Corps) have issued a proposed rulemaking that redefines most water bodies as “waters of the U.S.,” which is a fundamental change to the Clean Water Act. If promulgated, this proposed regulation would place more water bodies under the authority of the EPA and the Corps, which would result in more time consuming and expensive permits, regulatory red tape, and less economic development in communities across the country.

Zebra mussels confirmed in Cass Lake in Cass County

From the Department of Natural Resources

Zebra mussels confirmed in Cass Lake in Cass County
Zebra mussels have been confirmed in Cass Lake located in Cass County in northwestern Minnesota, according to the Department of Natural Resources.
A citizen discovered the zebra mussels earlier in the week while collecting shells on the beach on the southeast corner of Cedar Island. The area is a popular beach and swimming area where people park their watercraft to swim and fish.
Three hollow (dead) zebra mussels of varying sizes (ages) were collected. The samples were given to a DNR creel clerk who submitted them to the DNR area fisheries office in Bemidji where they were verified to be zebra mussels.
Following the identification, DNR staff conducted a search on Cass Lake around the northwest and southeast points of Cedar Island. The crew inspected more than 200 items along 565 feet of shoreline and 2,500 square feet of lake habitat and found zebra mussels in a variety of sizes.

“This is the first confirmed adult zebra mussel find in the Bemidji area,” said Nicole Kovar, DNR invasive species specialist.
